Ray Jones started working for MFI Ltd on the 25th June 2001 - he was interviewed & taken on by the General Manager himself - Click here to see the letter

Ray was already employed by another company when he had the interview & he was asked to start straight away because the lodge had been 2 men down for several months..

Ray's entire complaint centers around his Supervisor who was also given the job of Health & Safety Officer by the General Manager, the final part of the bullying campaign was carried out by the higher management & CEO of the company who fully support workplace bullying & those who commit this atrocious crime!!

These are the first concerns Ray had about his Supervisors incompetence

Ray only received 3 days training for a job that is very complex, he was never shown around outside of the lodge


Ray found out where the First Aid Office was when a worker who had split his head open was sent to Ray for treatment - the injured worker had to show Ray the First Aid Office

The other guards all received 2 weeks each before manning the lodge on their own


The red circle contains a message from the supervisor saying "good training as always" - one of the guards had trained the new guard up - not the supervisor. The date is 03/03/02 - 3 days after Ray's disciplinary where he complained about lack of training. The supervisor put a star next to it to wind Ray up - later on, the supervisor asked the guard who did the training for his notes because he was leaving - the supervisor did not have a clue how to do the job!!



The Supervisor would not speak to Ray face to face, instead, if Ray had made a mistake due to lack of training, the Supervisor would tell Ray's brother (another guard) to have a word with Ray about it.

The Supervisor told Ray it was none of his business when he asked what the companies annual losses due to theft were.

Ray's contract stated that he was entitled to overtime but the supervisor said his contract didn't apply to him because he was security so he never got overtime - when he signed his second contract, the overtime pay entitlement had been withdrawn without notice Contract 1 & Contract 2

Ray's contract also stated that he must take his holidays during shutdown & that he was entitled to take off any statutory holidays - but Ray had to work these because he was classed as security & again, he was told by his supervisor that his contract didn't apply to him.

Ray was told he would be taken on permanently after 6 months employment by his Supervisor - this never happened (the new guards who started after Ray were told that they would also be taken on after 6 months by the Supervisor even though he knew he was lying). It is important to point out here that the company have left themselves wide open to theft by taking on 'Temporary Guards' - Security have access to every part of every building, they know all of the companies secrets & are left on the site alone - if you knew you weren't going to be taken on permanently & you wanted to sabotage the company - your temporary status means the company are not committed to you so why should you be committed to the company? Taking on Temporary workers does save the company money but it could end up costing them more in the future - Ray was the very first temporary guard..

One of the other guards (who will be known as Guard3 from now on as he was one of the supervisors puppets) was doing all of the lodges rotas, fixing them to fit around his & his wife's jobs

& then one of the more serious issues - the Supervisor was allowing a 12 year old girl to wait for her father (a manager) in the lodge - this would not be so bad but the Supervisor was leaving goodie bags (sweets, crisps & fizzy drinks) for her behind the counter - she was swapping the keys round on the hooks, fiddling with the CCTV operating system so it never focused on what it should have been, dropping crisps all over the floor, she spilt her lemonade all over the CCTV operating system & she tripped over a heater that had been left in a passage way by the Supervisor (also H & S Officer) - Also, from where she was sitting, she could see pornographic pictures in the back room.. The Supervisor would leave her behind the counter with a lone guard when he went off shift & she witnessed part of the disgraceful verbal attack on Ray (we come to that later with the tape recording)

Ray put up with all of this because he enjoyed his job - he only saw the Supervisor when he relieved him after his day shift so he put up with it & he got on with his job. 


Ray was warned by his colleagues that their Supervisor was a bully - they told him never to complain about the rota & to watch everything that was said to the Supervisor as he would take everything you say & twist it in to a personal attack on himself. Ray was told that if the Supervisor didn't like you, he would start circling your work in the handover books & setting you up by leaving cryptic orders in the book - then the guards would be disciplined and get a final warning for nothing - they would then be told by the supervisor that they could either walk or face being sacked - why?? Because the Supervisor had decided that he personally did not like them so they had to go, even if there was nothing wrong with their work - this example was written by a guard who was bullied out of his job months before Ray started - he also complained to the General Manager about his supervisor but nothing was done

 


Then, several things occurred that could not be ignored

Ray was employed by the company as in house security but the jobs he was given were transport & managerial - not security, this meant that the Guards were paid less, not given bonuses, forced to work longer hours & forced to work on Bank & Statutory holidays - even though they did the jobs of several managers & kept the factory running of a night..

This is the guards real job description:

Shift Guard duties:

Work alternating shift patterns from afternoons to nights to days
Work three 12 hour shifts & one 13 hour shift per month
Operate the switchboard out of hours
Book the number & registration of every trailer that comes in or out of the factory.
Photocopy & deliver transport sheets / also weekend workforce registers.
Check & lock offices of a night / open offices in the morning.
Lift the barrier / close barrier.
Arrange cover from agency if workers / drivers don’t turn in.
Arrange for wagons to be repaired in time for departure the next day
Draw lines in the hand over book 
Stop & search duties
Handing out keys to drivers / staff.
Get the milk from the kitchens for day staff.
Test the alarms break glass tests.
Operating the CCTV system
Distributing internal mail & sending off factory mail.
Manage petty cash
Cleaning the lodge


The guards were not allowed to take a break away from the lodge – even to get something to eat, this happens on every shift including the 12 & 13 hour ones. It now transpires that Ray leaving his desk to go to the toilet was a sack able offence. The supervisor on the other hand had left himself free to spend all day in the HR Officer's Office or on the phone to her..

Security Supervisor’s duties:

Works 8am – 4pm Monday to Friday
Weekends off
Compile the security rota
Operate the switchboard during secretaries lunch hour.
Supervise.


The following are all of Ray's responsibilities (notice the Areas of responsibility sheet is dated December 94) You will see that all throughout his employment with the company, Ray was simply fulfilling his job descriptions. You will also see that Ray's responsibilities included First Aid & Fire Emergencies..

His supervisor was being given extra duties by the general manager - the supervisor, instead of carrying out these duties, decided to give the extra duties to the guards who were already overloaded with other peoples work 

The first message says that the General Manager had put the Supervisor in charge of  the company's pool vehicles - the second message says that the General Manager had put the supervisor in charge of Health & Safety for the lodge - later on that day, the supervisor puts Ray in charge of the pool cars "Ray in charge of pool cars" - he had only just started his job..



The company did not pay the guards overtime - they got time back instead - because guards kept leaving they were always a man down so Ray was forced to cover 4 men's time back the minute he started - This left him with shifts that were making him fear for his life & that of other road users because he was so tired & was not allowed to take a break from his desk during his shifts (a mixture of 8, 12 & 13 hour shifts) - This left him unable to eat in work & facing an hours drive to & from work after doing 15 of these shifts on the run. Ray spoke to his supervisor about it because he couldn't find any rotas from the past that were as bad as the ones he was getting, the Supervisor took the rotas off guard3 & started doing them himself although this version of events will be disputed by the supervisor later on - the supervisor 'went off' Ray because he now had to do some work or Ray would 'Rock the Boat'.  Click here for the rotas - the 8 hour turnarounds are highlighted.

The following morning, just as the Supervisor was relieving Ray's brother from the night shift, guard3 who had the rotas taken off him burst into the lodge & started bouncing round aggressively (he is a very big body builder & uses his size to intimidate) & screaming at Ray's brother saying that he had put ideas in Ray's head & that Ray & his brother had "fucked" guard3's life up. He went on to threaten Ray's brother with violence but because his brother wasn't scared, he calmed him down & told him to go home!

The minute guard3 left, the Supervisor told Ray's brother that he could have guard3 sacked for threatening him, all he had to do was put in a complaint and the supervisor would sack him on the spot but Ray's brother said no as it was just an argument & it would all be forgotten about the next day - the Supervisor seemed to be scared of guard3 for some reason.. This incident is referred to by the supervisor on the tape recording which we will come to later on


During the Boxing Night shift, an alarm went off at a warehouse belonging to 'the company' - Ray's brother, who was on duty alone that night, received a phone call from the police asking him to attend at the warehouse to reset the alarm. Ray's brother could not do this straight away - he was alone in the factory because it was shutdown so he phoned his supervisor for cover.

The Supervisor had been drinking & instead of getting a taxi into work, he told Ray's brother to sort it out - Ray's brother went on to ring three people - none of whom were available so he rang his supervisor back & asked him if he could just lock up & go as the police were waiting for him. His Supervisor refused to allow it & told Ray's brother to get either his wife or one of his lads to cover his shift.. Ray's brother had no other choice than to ask his 15 year old son to come in because he could get hold of no one else & the police were becoming impatient. This was an appalling situation for him to be in - although he wouldn't be gone for long, he still knew that he had left his son alone, guarding a factory that was empty & in total darkness. 

The following day, Ray's brother confronted his Supervisor & told him that he never wanted to be put in that situation again - the Supervisor wrote in handover book 31 that he was arranging cover for future incidents - this never actually happened & the guards are still left with the nightmare that they to might have to bring a member of their family in to cover their shift.

Ray was not happy about his Nephew being used in this way - Ray had worked in security for over 20 years, he had also been a supervisor & because of this he knew that his supervisor was incompetent, a danger to the people he was supposed to be protecting & a liability to the company. So Ray told him straight - if his supervisor didn't report this incident to the General Manager, then he would. The reason Ray was so outraged was because the company don't employ enough men to cover the workload - there are supposed to be 2 men on the night shift but the supervisor told the General Manager that his department could cope with 5 men instead of 6 

The Supervisor started running round the lodge in a disturbing manner screaming "your out to fuckin get me, I've got to watch my back when your around coz your out to fuckin get me"

It was at this moment that the Supervisor realised Ray could see he was incompetent & therefore a threat to his position of authority so he started a personal vendetta against Ray to undermine his work & sack him.
