After the disciplinary, Ray did not receive a letter stating why he had been disciplined, he requested one from HR but she wrongly assumed that she only had to send out a letter after Ray had appealed - Ray couldn't remember what he had been disciplined for & he now knew he was going to lose his job - his union were of no help saying there was nothing he could do. Ray attempted to speak to HR about his supervisor bullying him but she refused to speak to him - Ray had no other choice than to write a letter to the General Manager to ask for help, 4 days after the disciplinary. Ray turned up for the afternoon shift early on 04/03/02 & went up to the General Managers Office - he handed the letter into his secretary & asked for her assurance that he got it, which she gave him. This is what the letter said: 04/03/02 Dear
Jim Turner, Due
to recent events, the outcome of which resulted in me be given a final
warning, I would greatly appreciate a meeting with yourself to discuss
my supervisor, who is attempting to constructively dismiss me. I
am only a temporary worker, which means I have no rights – I have been
warned by my supervisor that I would be sacked if I “rocked the
boat” by talking to you but I feel that this is my only option as my
supervisor has the apparent power of Judge, Jury & Executioner. I
have been given a “final warning” for 10 different issues covering
an 8-month period. My supervisor has already spoken to me about several
of these issues, which were minor mistakes due to lack of training that
have not reoccurred, two of them are complete fabrication & the
final one my
supervisor decided
not to bring up at this time. HR
have told me to submit an appeal if I am unhappy with being given a
final warning but I cannot sit in another meeting with a bullying
supervisor & a HR Officer who keeps stating that I am “Just a
temp”. No dates were given for the accusations in the disciplinary
& the handover book, which could vindicate me, has been in my
supervisor's possession
for the last few weeks & he has refused to bring it back. Every time
I attempted to explain the issues, he would call me a liar – I was
unable to say anything in my defense. Because of these reasons, and the
fact that he is a supervisor, not a manager & it was you that hired
me, I ask that you please look into the matter, as I fear I won’t get
a fair hearing. I
feel I have done a good job since starting at MFI Runcorn and I have
gained the respect of every person I work with – including managers, my
supervisor is
the only person who is unhappy with me. I enjoy my job, I have even come
into work when I have been ill – I have shown nothing but commitment
& I now fear I am going to lose my job. My supervisor has hinted
that he has another guard lined up - sealing my fate. I
have feared for my job for several months because my
supervisor, Billy Taylor has
been psychologically bullying me, victimizing me, treating me unfairly
& singling me out since raising my concerns over a serious incident
involving Halton Warehouse. My fears were confirmed at the
disciplinary. I
don’t feel I could go through an appeal as the current events have
left me feeling very depressed. Yours
Sincerely Ray
Jones Because the next bit is a bit complicated, we've taken a chunk out of Ray's statement: RJ
- I relieved my supervisor as usual on the Monday after handing in the
letter to the General Manager's Office, it was the first time I had seen
my supervisor since the disciplinary - I read through the book &
came across the message: Ray,
Guard1, Guard2 – check area on cctv 7.30 to 2 scratch car – I
don’t think this area as covered by view” I asked my supervisor for
the car model to which he replied, “I don’t know” – I asked for
the owners name to which he replied, “I don’t know” & I asked
for the location it happened to which he replied “I don’t know, over
there” My
supervisor had not put this information in the book when this is the
information security require – I now think that this incident didn’t
happen – my supervisor knew nothing about anything that he had written
in the book & he left a cryptic message instead of a detailed one.. I requested book 31 for my appeal & my supervisor said “tough” – because he was using this book as evidence against me, I decided to write my request & his reply in the book which was ‘tough’ As
a parting shot he said “What do you want to appeal for, I’ve got 20
things on you” & he walked out… LA
– How did you feel now? RJ
– I felt like I could cope with it because I honestly thought the
General Manager was about to bring my supervisor's reign of terror to an
end – so I ignored him & got on with my job – One of our Union
Reps came in straight after my supervisor left & I told him what he
had just said to me – the Rep told me to again request book 31 as it
would vindicate me & he told me to come in early the next day to
discuss it with another Union Rep. LA
– What happened next? RJ
– The next day came, Tuesday – the General Manager hadn’t got in
touch with me & I couldn’t face my supervisor again – the man is
impossible & to be honest, I would have been made up never to see
him again as long as I lived. Time was ticking on & my shift was
getting closer – At this point I remembered bits of conversations with
my
supervisor
“The General Manager says we don’t make him money, we cost him
money” & “If you rock the boat by seeing the General Manager
he’ll sack us all & get contract guards in” – I had been led
to believe that the General Manager was an ogre from day one, but as he
hired me - I thought he would protect me. He didn’t get in touch &
I was forced to go to work yet again. LA
– How did this make you feel? RJ
– Sick to the stomach – I now had to go in & listen to more lies
from my supervisor & suffer another verbal tirade which I had to put
up with – I couldn’t understand why the General Manager didn’t get
in touch with me – I mentioned in the letter how serious the situation
was & that I was feeling depressed but he still didn’t get back to
me – I couldn’t believe it! LA
– So what did you do? RJ
– I bought a Dictaphone – After my supervisor saying he had 20
things on me & him already giving me a final warning, the General
Manager ignoring me & no one believing me I felt that I had no other
choice than to tape record him. LA
- So what happened? RJ
– I got to work, entered the lodge & went straight over to the
hand over book & there it was - my supervisor's campaign to sack me
has reached it’s peak – there in the book was everything he needed
to get me sacked – a load of lies written by him in the book with the
message “HR informed” & he had also wrote “LIAR” next to my
recorded “tough” comment the day before LA
– What were the messages? RJ
– RAYMOND reply to your messages: 3.
Ray I asked you to view vid – did you do it? Where’s message 4.
Ray, * ******* said he gave you laminated sheet for me yesterday
– no message in book / where is it? LA
– So did you get photocopies of the book? RJ
– No, he wouldn’t give them to me because he knew it would go
against him & prove he is a bully who was trying to get me sacked!! LA
– Ok, can we run through the tape – do you feel ok with it? WARNING
